Terms of Service

These Terms of Service ("Terms") govern your use of Blackwood Retreat's services and your stay at our property located in Neagra Șarului, Sarul Dornei, Suceava County, Romania. By making a reservation, you agree to be bound by these Terms.

1. Booking and Reservations

1.1 Booking Confirmation

  • A reservation is confirmed only after full payment is received
  • Confirmation will be sent via email within 24 hours
  • Bookings are subject to availability
  • We reserve the right to refuse any booking

1.2 Booking Requirements

  • Primary guest must be at least 25 years old
  • Valid government-issued ID required at check-in
  • Credit card required for security deposit
  • All guests must be registered at time of booking

1.3 Pricing and Payment

  • All prices are quoted in Euros (EUR)
  • Prices are subject to change until booking is confirmed
  • Full payment required at time of booking
  • Additional charges may apply for extra services
  • Local tourist tax may be collected separately

2. Property Use and Guest Responsibilities

2.1 Occupancy

  • Maximum occupancy must not be exceeded
  • Only registered guests allowed to stay overnight
  • Subletting or assignment of booking is prohibited
  • Commercial activities on property are not permitted

2.2 Property Care

  • Guests are responsible for any damage to property
  • Property must be left in reasonable condition
  • Report any damages or issues immediately
  • Excessive cleaning fees may be charged

2.3 Prohibited Activities

  • Illegal activities of any kind
  • Parties or events without prior approval
  • Excessive noise during quiet hours
  • Smoking inside the cabin
  • Bringing unregistered pets
  • Removing property items from premises

3. Liability and Disclaimers

3.1 Limitation of Liability

Blackwood Retreat shall not be liable for:

  • Personal injury or death except where caused by our negligence
  • Loss or damage to personal property
  • Indirect or consequential losses
  • Acts of nature or force majeure events
  • Disruption to utilities beyond our control
  • Actions of other guests or third parties

3.2 Guest Assumption of Risk

Guests acknowledge and assume risks associated with:

  • Use of hot tub and spa facilities
  • Fire pit and BBQ equipment
  • Hiking and outdoor activities
  • Wildlife encounters
  • Weather conditions
  • Natural terrain and surroundings

3.3 Indemnification

Guests agree to indemnify and hold harmless Blackwood Retreat from any claims, damages, or expenses arising from:

  • Violation of these Terms
  • Damage to property
  • Injury to other guests or third parties
  • Violation of any laws or regulations

4. Cancellations and Refunds

Please refer to our separate Cancellation Policy for detailed information about cancellations and refunds.

5. House Rules

All guests must comply with our House Rules. Violation of house rules may result in immediate termination of stay without refund.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Security Deposit

  • Security deposit of €500 required
  • Hold placed on credit card at check-in
  • Released within 7 days after departure
  • Deductions may be made for damages or violations
  • Additional charges may apply for excessive damages

8. Check-in and Check-out

  • Check-in: 3:00 PM - 10:00 PM
  • Check-out: Before 11:00 AM
  • Late check-in/out available by arrangement
  • Additional fees may apply for late check-out
  • Keys must be returned at check-out

9. Amenities and Services

  • Amenities provided on "as available" basis
  • We reserve the right to withdraw amenities for maintenance
  • No guarantee of continuous availability
  • Alternative arrangements offered where possible

10. Force Majeure

We shall not be liable for any failure to perform our obligations due to:

  • Acts of God or natural disasters
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Pandemic or health emergencies
  • Utility failures beyond our control
  • Other circumstances beyond reasonable control

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Romania.

11.2 Dispute Process

  • First attempt: Direct negotiation
  • Second attempt: Mediation
  • Final resort: Romanian courts

11.3 Jurisdiction

Any legal proceedings shall be brought in the courts of Suceava County, Romania.

12. Modifications to Terms

  • We reserve the right to modify these Terms
  • Changes effective immediately upon posting
  • Continued use constitutes acceptance
  • Major changes communicated via email

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our House Rules, Cancellation Policy, and Privacy Policy, constitute the entire agreement between you and Blackwood Retreat.

In case of emergency:

  • Fire extinguishers located in kitchen and near hot tub
  • First aid kit in main bathroom

17. Language

These Terms are provided in English. In case of translation discrepancies, the English version prevails.

18. Acknowledgment

By making a reservation at Blackwood Retreat, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
